GENERAL COUNSEL

Ira Genberg is a senior partner and head of the Construction Law and Litigation Departments at the century-old Atlanta law firm of Smith, Gambrell & Russell, LLP. Mr. Genberg is known nationally and internationally for his litigation skills. His significant trial victories in complex litigation have attracted the attention of the Wall Street Journal, the Washington Post, the London Times and the Atlanta Journal. Recently he won for his client a precedent-setting victory against the House of Commons, which established new law throughout the European Community; and as counsel for a group of industrial contractors in another landmark case, he proved the existence of a nationwide price-fixing conspiracy, the damage and injunctive relief amounting to nearly $500 million.

Mr. Genberg has been selected as one of the country's most outstanding lawyers by a national survey naming him on its final list of 75 American lawyers. The survey considered the views of counsel at Fortune 1000 companies.

Mr. Genberg has also been:

  • Listed in Chambers USA Ranking Guide of "America’s Leading Business Lawyers;"

  • Elected to membership in "Outstanding Lawyers of America" (limited to 100 members per state);

  • Selected by his peers to Georgia’s "Super Lawyers," and to "Top 100 Georgia Super Lawyers," as featured in Atlanta Magazine ;

  • Selected by his peers to Georgia’s "Legal Elite," as featured in Georgia Trend Magazine.

Mr. Genberg is the general counsel to the nation's largest group of commercial and industrial owners of property (Associated Owners and Developers), whose members include DuPont, Marriott Hotels, Disney, Intel, Home Depot, Tishman, Mercedes-Benz, Princeton University, AMEC, Marsh, PricewaterhouseCoopers, Georgia Pacific and Sun International. He represents major corporations throughout the United States, Canada, Europe and South America and is currently lead counsel in numerous complex multi-million dollar lawsuits. The majority of these cases have arisen out of disputes concerning delays, disruptions and claims for extra work on high-rise buildings, power plants, hospitals, civic centers, hotels and highways. Further, Mr. Genberg led the effort to draft AOD 2000, a comprehensive industry-wide construction agreement.

Mr. Genberg has been a panelist at the United States Judicial Conference for the Eleventh Circuit; has chaired and spoken at seminars on construction law and trial strategy throughout the country; has authored or co-authored twenty-six published articles on construction law; and has served on the Board of Atlanta's Red Cross and on the Steering Committee for the Home Project. He has been regularly selected to "Who's Who in America" and "Who's Who in American Law," and recently chosen by the Biographical Center in Cambridge in its first publication of "One Thousand Great Americans."

His novel Reckless Homicide has received overwhelming acclaim, has sold nearly a half million copies, and was nominated for the Edgar Allen Poe Literary Award for best American novel. Mr. Genberg donated his royalties on the hardcover and paperback editions of Reckless Homicide to the United Way, which monies were used in part to create a new program through Atlanta Legal Aid to help those with cancer, ALS, and other life-threatening diseases cope with legal problems, such as disputed insurance coverage, Social Security benefits, estate planning, and the like.

Mr. Genberg is a Phi Beta Kappa and magna cum laude graduate of Rutgers University. He received his J.D. degree from the University of Pennsylvania Law School, where he served as Editor of the Moot Court Board and was the recipient of the American Jurisprudence Award.
